Terms of Service

Welcome to The Status. These Terms of Service ("Terms") govern your access to and use of The Status software, applications, and services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
By accessing or using The Status, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to these Terms.
The Status is an order tracking and display system designed for service businesses. The Service allows businesses to display real-time order status updates on monitors for customers, manage orders through a dashboard interface, and integrate with point-of-sale systems via webhooks. The Status is offered in multiple tiers, including The Status Lite (manual order entry) and The Status PRO (automated POS integration).
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
By creating a The Status account, you expressly consent and opt-in to receive promotional emails, marketing communications, product updates, newsletters, and other commercial messages from The Status at the email address you provide during registration. This consent is a condition of account creation and use of the Service. You may unsubscribe from promotional emails at any time by clicking the "unsubscribe" link included in each email or by contacting us directly. Please note that even if you opt out of promotional emails, we may still send you transactional or administrative messages related to your account, such as service announcements, security alerts, and billing information.
Certain features of the Service may require payment of fees. You agree to pay all applicable fees as described on our website or within the Service. All fees are non-refundable except as expressly stated in this section.
Refunds are ONLY issued within thirty (30) days of account creation. To request a refund within this period, you must contact our support team with your account details and reason for the refund request. After the 30-day period from account creation, all payments are final and non-refundable. No refunds will be issued for partial months of service, downgraded accounts, or unused features.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not: (a) use the Service in any way that violates any applicable law or regulation; (b) attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service; (c) use the Service to transmit any malicious code, viruses, or harmful data; (d) interfere with or disrupt the integrity or performance of the Service; or (e) attempt to reverse engineer, decompile, or disassemble any portion of the Service.
The Service and its original content, features, and functionality are owned by The Status and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited license to use, store, and process your data solely for the purpose of providing and improving the Service. We will handle your data in accordance with our Privacy Policy.
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE STATUS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
You agree to indemnify, defend, and hold harmless The Status and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located within the United States.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Effective Date" above. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Status regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral, regarding the subject matter herein.
